Privacy Statement Overview

Overview. This Privacy Statement does not govern privacy practices associated with offline activities, websites other than the Site, or products and services not available or enabled via the Site, except as expressly set forth in Section 4 (Links to Other Sites). To the extent that any terms of the Privacy Statement conflict with the terms of an existing written (including electronic) agreement between you and BonBon Break regarding the use of specific areas of the Site or specific services (collectively, the “Other Agreements”), the terms of such Other Agreements shall govern. Because we continue to develop the Site and take advantage of technologies to improve the services we provide, our policies will change over time. We encourage you to refer to this Privacy Statement frequently to stay aware of our most current privacy policy practices. Any changes that we make to the Privacy Statement will be made in accordance with Section 9 (Privacy Statement Updates). If you have objections to the Privacy Statement, or any proposed changes to the Privacy Statement, you should immediately discontinue use of the Site and any services enabled by the Site and follow the procedure described in Section 9 (Privacy Statement Updates).

1. Information We Collect. Except as disclosed in this Privacy Statement, we do not sell or disclose information that identifies our users of the Site personally or makes it possible for other parties to contact them directly (“Personal Information”). We also collect non-personal information (“Anonymous Information”), such as pages visited, on the Site. We may also collect or develop aggregated information, which may include Anonymous Information and Personal Information, provided that such information does not personally identify you or any of our other users (“Aggregated Information”).

  • a. A Note About Children. We do not intentionally gather Personal Information about users who are under the age of 13.
  • b. Voluntarily Provided Information. As a visitor to the Site, you can engage in many activities without providing any Personal Information. When you participate in one of our surveys or contests, we may collect additional profile information. When you post content (text, images, photographs, messages, comments or any other kind of content that is not your email address) on our Site, the information contained in your posting will be stored on our servers and other users will be able to see it. We may also collect Personal Information, such as demographic information, from you at other points on our Site that state that Personal Information is being collected.     (ii) Surveys and Polls. BonBon Break offers online surveys and questionnaires that ask users for opinions on various issues and/or other information. Occasionally, we may request demographic information (like zip code, age or gender) when you answer a survey. Such surveys are completely voluntary.
    (iii) Sweepstakes and Contests. We regularly operate sweepstakes, contests and giveaways throughout the Site. We generally ask you for your email address and/or home number (to notify you if you win, or not). We may also ask for first and last names, and sometimes post office addresses to verify the entrant’s identity. In some situations, we may need additional information as part of the entry process, such as a prize selection choice. These sweepstakes and contests are completely voluntary. We recommend you read the rules for each sweepstakes and contest you enter.
  • BonBon Break may also collect Anonymous Information, including IP Addresses, about your online activities and share this information with one or more third parties for use in tailoring ads to users on the Site and on third party sites and in analyzing and reporting on the advertising that you see. As a part of our commitment to respect privacy concerns, we will, and we will require such third parties to, provide users with the ability to opt out of such use.
  • d. Click Tracking. As is true of most websites, BonBon Break gathers certain information automatically and stores it in log files. This information includes IP Addresses, browser type, internet service provider (“ISP”), referring/exit pages, operating system, date/time stamp, and clickstream data. We use this information to analyze trends, administer the Site, track users’ movements around the Site and gather demographic information about our user base as a whole. Except as noted in this Privacy Statement, we do not link this automatically-collected data to Personal Information.
  • e. IP Addresses. Your IP Address is a number that is assigned by your ISP(ISP) to your computer to identify its location. Each user’s IP Address is logged with each visit and each action performed on the Site. This information is never provided to the third parties, except as otherwise stated in this Privacy Statement, and is logged only for a temporary period of time.
  • f. Advertising. If there is advertising on the Site, such advertising may employ the use of cookies or other methods to track hits and click-throughs. If you click on these advertisements, these companies may place a persistent cookie on your computer which may allow them to display further advertisements to you. We are not responsible for advertiser cookies or how the information gathered through their use might be used.   • g. Participation on a Public Website. You should be aware that any Personal Information you submit on the Site in blogs, comments, other posts and your user profile can be read, collected, or used by other users of the Site, including anonymous visitors, and could be used to send you unsolicited messages. We are not responsible for the Personal Information you choose to submit on the Site.
  • h. Aggregated Information. We may collect, compile, store, publish, promote, report, sell, or otherwise disclose or use any and all Aggregated Information. When we share such information with other companies, it is not traceable to any particular user, and will not be used to contact you.

2. Use of Your Information.

When you receive newsletters or promotional communications from us, you may indicate a preference to stop receiving further communications from us and you will have the opportunity to “opt-out” by following the unsubscribe instructions provided in the e-mail you receive or by contacting us directly. Despite your indicated e-mail preferences, we may send you notices of any updates to our Privacy Statement. BonBon Break also offers the ability to forward an article to another person via email. If you use this service, we will use the recipient’s email address in order to send the article and we will also ask for your email address. We may create Anonymous Information and Aggregated Information from Personal Information by excluding information (such as your name) that make the data personally identifiable to you. We reserve the right to offer third party services and products to you on the Site,  via newsletters or special offers, based on the preferences that you identify during the registration process and based on your subsequent preferences. We may share Aggregated Information about our user base with other entities, such as advertisers. This information does not identify individual users, except where you have given us prior, specific permission to do so. We do not link Aggregated Information with Personal Information. We may share Personal Information with third-party vendors and partners only in those situations where you have given us prior, specific permission to do so.

5. United States Law. Much of BonBon Break’s membership, our servers and databases are primarily located in the United States. Like almost every other website, the Site may be accessed by an international audience. If you are a non-U.S. user of the Site, by visiting the Site and providing us with data, you acknowledge and agree that your Personal Information may be processed for the purposes identified in this Privacy Statement. 7. Dispute Resolution. BonBon Break takes its users’ privacy concerns seriously. In your email, please describe in as much detail as possible the ways in which you believe that the Privacy Statement has not been complied with. We will do our best to address your concerns. If you and BonBon Break are unable to reach a resolution to the dispute, BonBon Break will cooperate with JAMS pursuant to the JAMS International Mediation Rules, which are accessible on the JAMS website at www.jamsadr.com/rules-international-rules. JAMS mediation may be commenced as provided for in the JAMS International Mediation Rules. The mediator may propose any appropriate remedy, such as publicity for findings of non-compliance, payment of compensation for losses incurred as a result of non-compliance, or cessation of processing of the Personal Information of the individual who has brought the complaint. BonBon Break will assume the costs of the administrative fees if the mediator makes a written recommendation that finds BonBon Break in breach of its duties pursuant to the Safe Harbor. The mediator or the individual may refer the matter to the U.S. Federal Trade Commission, which has Safe Harbor enforcement jurisdiction over BonBon Break.
BonBon Break conducts periodic self-assessments to verify that the attestations and assertions it makes about its privacy practices are true and that such privacy practices have been implemented as presented. BonBon Break will take steps to remedy any problems arising out of failure to comply with the Safe Harbor principles.

8. Review of Anonymous Data from Google Analytics

We are committed to ensuring that our website contains content that is valuable and useful to our readers. To help us with this we have implemented the Google analytics demographics and interest reporting features on our website. These tools allow us to review anonymous data regarding the gender, age and interests of website visitors and adapt our website content to better reflect their needs. Although this information is collected through your Google ad settings, it is not provided to us in a personally-identifiable format. This means we cannot identify what information is about you, and we will not try to figure it out.

If we decide to make material changes to our Privacy Statement, we will notify you by sending you an e-mail to the last e-mail address you provided to us and/or by prominently posting notice of the changes on the Site and updating the date at the top of the Privacy Statement. The Website works with Mediavine to manage third-party interest-based advertising appearing on the Website.
